Terms of Service

All products and services provided by The Cheesecake Boutique are subject to the following terms and conditions.

Product Information and Allergens

Our products may contain or come into contact with common allergens, including but not limited to milk, eggs, wheat, soy, peanuts, tree nuts, and coconut.

It is the customer’s responsibility to review product information and contact us before placing an order with any allergy-related questions or concerns. It is also the customer’s responsibility to inform any recipients or guests of potential allergens.

By purchasing from The Cheesecake Boutique, you acknowledge that we are not an allergen-free bakery and cannot guarantee that cross-contact will not occur. The Cheesecake Boutique is not liable for allergic reactions resulting from the consumption of our products.

Product Care and Storage

Our cheesecakes are perishable and should be handled and stored properly to maintain quality and food safety. Storage and serving recommendations will be provided where applicable.

Once an order has been picked up, delivered, or otherwise released to the customer or the customer’s representative, the customer assumes full responsibility for proper handling, transportation, storage, and serving of the products.

Pricing and Quotes

All prices listed on our website are subject to change without notice.

Any custom quote, invoice, or special pricing provided outside of the website is valid for 7 days unless otherwise stated.

Applicable sales tax will be added where required by law. Tax-exempt customers must provide a valid Georgia ST-5 form before payment is made in order to have sales tax removed.

Payments

Full payment is required before production, fulfillment, or shipment of any order.

We accept approved electronic forms of payment made available at checkout or by invoice. Orders are not confirmed until payment has been successfully received.

For approved invoiced orders, payment terms will be stated on the invoice. Late payments may be subject to fees, including a $10 late fee plus a 3.5% processing fee. Checks are not accepted for overdue balances.

Order Changes and Cancellations

Because our products are made to order and production begins in advance of fulfillment, all sales are final unless a cancellation is expressly approved by The Cheesecake Boutique.

If you need to request a cancellation, please contact us as soon as possible. If a cancellation is approved, your refund will be issued less any applicable payment processing fees, administrative costs, and any production or supply costs already incurred.

At minimum, an approved cancellation will be subject to a $5.00 non-refundable processing fee.

Orders that have already entered production, been prepared, shipped, or are scheduled for same-day pickup or delivery may not be eligible for cancellation or refund.

If The Cheesecake Boutique must cancel an order due to circumstances beyond our control, including illness, emergency, or other unforeseen events affecting our ability to fulfill the order, any eligible refund will be issued within a reasonable timeframe.

Shipping and Delivery

The Cheesecake Boutique offers shipping on designated shipping days as stated on our website. Customers are responsible for reviewing shipping schedules, processing timelines, and cutoff times before placing an order.

We are not responsible for delays caused by carriers, weather, incorrect shipping information provided by the customer, missed deliveries, or circumstances outside of our control once an order has been tendered to the carrier.

For local delivery orders, delivery fees and availability are based on location and order details. Any delivery date, timeframe, and drop-off instructions provided by the customer must be accurate and complete.

Once a delivered order has been dropped off at the provided address or accepted by the customer or recipient, responsibility for the product transfers to the customer.

Pickup

Curbside pickup is available for eligible orders. Pickup instructions, including location and pickup procedures, will be provided with your order.

It is the customer’s responsibility to inspect the order at pickup. Once the order has been released to the customer or the customer’s representative, The Cheesecake Boutique is no longer responsible for damage caused by transport, improper storage, or mishandling.

If someone other than the customer picks up the order, that person will be considered the customer’s designated representative.

Refunds and Quality Concerns

Due to the perishable nature of our products, we do not offer refunds for issues related to taste preferences, minor decoration variations, or circumstances resulting from improper handling after pickup, delivery, or shipment.

If you believe there is a problem with your order, you must contact us promptly with your order number, a description of the issue, and photos when applicable. Any resolution is at the sole discretion of The Cheesecake Boutique.

Availability

All products are subject to availability. We reserve the right to limit quantities, substitute packaging when necessary, or discontinue products at any time without notice.

Intellectual Property and Photography

We reserve the right to photograph and use images of our products for marketing, advertising, website content, social media, and other promotional purposes.

All website content, product descriptions, branding, logos, images, and text are the property of The Cheesecake Boutique and may not be copied or used without permission.

Limitation of Liability

To the fullest extent permitted by law, The Cheesecake Boutique shall not be liable for indirect, incidental, special, or consequential damages arising from the purchase, delivery, shipment, pickup, or consumption of our products.

Our maximum liability for any claim relating to an order shall not exceed the amount paid for that order.
